Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Outside The Box, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Outside The Box and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. SECTION 20 - OTB Rewards Program Terms & Conditions

20.1 Introduction

These terms govern participation in the OTB Rewards Program ("Program") operated by Outside The Box, a retail store located in New Farm, Brisbane, Queensland, Australia and operating online at outsidethebox.gallery. By enrolling in or using the Program, you ("Member") agree to be bound by these terms. If you do not agree, you should not enrol or continue to participate. These terms should be read in conjunction with our Privacy Policy and Website Terms of Use. In the event of any inconsistency, these Program terms prevail with respect to the Program.

20.2 Eligibility & Enrolment

The Program is open to individuals aged 18 years or older who are residents of Australia. It is not available to employees of Outside The Box or their immediate family members unless otherwise approved in writing. Membership is personal and non-transferable, and only one account is permitted per person. Membership may be created in-store at the point of sale or online at outsidethebox.gallery. You must provide accurate and current personal information at enrolment, including your name and email address. By enrolling, you consent to the collection and use of your personal information in accordance with our Privacy Policy. We reserve the right to decline any enrolment application at our absolute discretion without providing reasons.

20.3 Earning OTB Rewards Points

Members earn OTB Rewards Points ("Points") at a standard rate of 1 Point for every $1.00 AUD spent on eligible purchases, whether in-store or online. New Members receive a one-time welcome bonus of 250 Points upon successful enrolment, credited to their account within a reasonable time. The welcome bonus is awarded once per person and cannot be claimed more than once. From time to time, Outside The Box may offer bonus Points on specific products, categories, events, or during promotional periods. Promotional Points are subject to their own terms communicated at the time of the promotion, and Outside The Box reserves the right to offer, modify, withdraw, or discontinue any Promotional Points offer at any time without notice.

Points are earned on net purchase amounts excluding GST, delivery fees, and any amounts paid using Points redemptions. Points are not earned on purchases made prior to enrolment, gift cards, store credit, delivery or shipping fees, or any products expressly designated as ineligible by Outside The Box from time to time. Points are credited following the completion and payment of an eligible transaction and will not be credited for transactions that are later reversed, refunded, or cancelled. Outside The Box is not responsible for Points that fail to be credited due to technical errors; Members should contact us promptly if they believe Points have been missed.

20.3A Referral Bonus — Limited Time Offer

From time to time, Outside The Box may offer a referral bonus to existing Members who successfully introduce new Members to the Program. During the current limited-time referral promotion, the following applies:

Existing Members who refer a new Member will receive 100 OTB Rewards Points credited to their account once the referred person has successfully enrolled in the Program and completed their first eligible purchase. The referred new Member must be a genuinely new Member with no prior account. Self-referrals, referrals of existing Members, or referrals involving duplicate or fraudulent accounts will not qualify and may result in account suspension under clause 20.6. Referral Points are awarded once per successful referral per existing Member, subject to verification at our discretion. This referral offer is available for a limited time only and may be withdrawn, modified, or extended by Outside The Box at any time without notice. Outside The Box reserves the right to determine in its sole discretion whether a referral qualifies for the bonus. Standard Program terms apply to all Points earned through the referral offer.

20.4 Redeeming Points — Cash Discounts

Points may be redeemed for cash discounts on eligible purchases at a rate of 500 Points = $5.00 AUD off your order. Redemptions must be made in multiples of 500 Points and partial redemptions below 500 Points are not permitted. There is no minimum spend required to redeem Points. Redemptions are subject to a maximum annual cap of $300.00 AUD per Member per calendar year (equivalent to 30,000 Points per calendar year), running from 1 January to 31 December. Points in excess of the annual cap remain in your account and may be redeemed in subsequent calendar years. Outside The Box reserves the right to decline or reverse a redemption that would cause a Member to exceed the annual cap.

Points redemption discounts cannot be combined with or applied to products already subject to a promotional price, markdown, sale price, or any other discount at the time of purchase, nor with any other voucher, coupon, discount code, store credit, or third-party promotional arrangement unless expressly stated otherwise by Outside The Box. For the avoidance of doubt, if a product's price has already been reduced from its regular retail price at the time of the transaction, Points may not be redeemed against that product in that transaction.

To redeem in-store, advise a team member at the point of sale. To redeem online, log into your account at outsidethebox.gallery and apply your Points at checkout. Points redemptions are processed at the time of the transaction and cannot be applied retrospectively. If a purchase for which Points were redeemed is subsequently returned or refunded, the discount applied by the redemption will not be refunded in cash. At our discretion, we may restore redeemed Points to your account in appropriate circumstances. Points earned on a purchase that is subsequently returned or refunded will be reversed from your account.

20.5 Points Balance, Expiry & Account Status

Points do not expire while the Program is active and your membership account remains in good standing. Points will remain valid and redeemable for as long as Outside The Box operates the Program as a going concern. Members may check their Points balance by logging into their account at www.outsidethebox.gallery or by asking a team member in-store. Points balances displayed are indicative and subject to confirmation. Members may cancel their membership at any time by contacting us at outsidethebox.aus@gmail.com. Upon cancellation, any outstanding Points balance will be forfeited and cannot be redeemed. We will not provide cash or any other compensation for forfeited Points on voluntary cancellation.

20.6 Account Suspension & Cancellation by Outside The Box

Outside The Box reserves the right to suspend, cancel, or terminate a Member's account and forfeit accumulated Points without notice if, in our reasonable opinion, a Member has provided false, misleading, or fraudulent information; engaged in fraudulent conduct including manipulating transactions, creating duplicate accounts, or exploiting system errors; abused or harassed staff or other customers; breached any of these terms; or engaged in conduct detrimental to the Program or our business. Outside The Box will not be liable to a Member for any loss, damage, or inconvenience arising from account suspension or cancellation on these grounds.

20.7 General Points Conditions

Points have no cash value and cannot be sold, transferred, gifted, or otherwise assigned to another person or account. Points may not be combined between separate Member accounts. Outside The Box does not guarantee that Points will be available for redemption in perpetuity and is not liable if Points cannot be redeemed due to circumstances beyond our reasonable control. Any Points credited as a result of error, system malfunction, or fraud may be reversed or cancelled at any time. Outside The Box is not responsible for any tax implications arising from participation in the Program; Members should seek independent tax advice if required.

20.8 Amendments to These Terms

Outside The Box reserves the right, at its absolute discretion, to amend, update, or replace these terms — including Points earn rates, redemption rates, the annual cap, eligible products, and any other Program feature — at any time. Material changes will be communicated to Members by email (where held) and/or by notice at outsidethebox.gallery/rewards-terms, with at least 14 days' notice before material changes take effect where reasonably practicable. Continued participation in the Program after the effective date constitutes acceptance of the amended terms. For minor or administrative changes, or where required by law, changes may take effect immediately. Outside The Box reserves the right to run promotions and bonus Points events at any time subject to their own terms; promotional terms do not form a permanent variation of these terms unless expressly stated.

20.9 Privacy & Data

Outside The Box collects personal information from Members for the purpose of administering the Program, communicating with Members, and improving our products and services, in accordance with our Privacy Policy available at outsidethebox.gallery/privacy. You have the right to access, correct, and request deletion of your personal information, subject to applicable law, by contacting hello@outsidethebox.gallery. By participating in the Program, you consent to receiving Program-related communications from Outside The Box. You may opt out of marketing communications at any time.

20.10 Program Discontinuation

Outside The Box reserves the right to suspend or permanently discontinue the Program at any time. In the event of permanent discontinuation, we will provide Members with at least 30 days' written notice via email and/or website notice where reasonably practicable, and Members will be given a final redemption window of no less than 30 days to redeem any outstanding Points balance. After the final redemption window closes, all outstanding Points will be extinguished and no compensation will be payable.

20.11 Limitation of Liability

To the maximum extent permitted by applicable law, including the Australian Consumer Law, Outside The Box does not exclude any guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law. Outside The Box's liability to you in connection with the Program is limited, at our election, to the value of Points at stake in the relevant dispute. Outside The Box is not liable for any indirect, consequential, incidental, or special loss or damage arising from or in connection with the Program, including any inability to earn or redeem Points due to technical failure, system outage, or circumstances beyond our reasonable control.

20.12 Governing Law

These terms are governed by the laws of Queensland, Australia. Any dispute arising from or in connection with the Program or these terms will be subject to the non-exclusive jurisdiction of the courts of Queensland.
